These Terms of Service ("Terms") govern your use of BidIntell ("Service"), operated by BidIntell ("we," "us," or "our") at bidintell.ai. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
BidIntell is an AI-powered bid intelligence platform for construction industry professionals. The Service allows you to upload bid documents, receive AI-generated analysis and scoring, track bid outcomes, manage client relationships, and generate business intelligence from your bidding activity.
To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and have authority to bind any business entity on whose behalf you use the Service.
The Service launched in a beta period with free access for approved users. Paid subscriptions begin April 1, 2026. After the beta period ends, the following plans apply:
Users who joined during the beta period and were promised a founding member discount will receive that discount applied to their subscription. Contact hello@bidintell.ai if your discount has not been applied.
Subscriptions are billed monthly via Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through the in-app billing portal or by contacting support. No refunds are provided for partial billing periods.
You agree to use the Service only for lawful business purposes. You must not:
You retain ownership of all documents, data, and content you upload to the Service ("Your Content"). By uploading content, you grant us a limited license to process and analyze it for the purpose of providing the Service to you. We do not sell Your Content or share it with third parties except as necessary to operate the Service (see Privacy Policy).
AI analysis outputs generated from Your Content are provided for informational purposes only and do not constitute legal, financial, or professional advice. You are responsible for all bid decisions made using the Service.
BidIntell uses AI to analyze bid documents and score opportunities. AI analysis is probabilistic and may contain errors or omissions. BidIntell scores and recommendations are decision-support tools, not guarantees of outcomes. We are not liable for any business decisions made based on Service outputs.
The BidIntell platform, including the BidIndex scoring system, AI models, interface design, and documentation, are proprietary to BidIntell. Nothing in these Terms transfers any intellectual property rights to you except the limited license to use the Service as described herein.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service at any time. We will provide reasonable advance notice for planned downtime when possible.
To the maximum extent permitted by applicable law, BidIntell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of or inability to use the Service. Our total liability to you for any claims under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
You agree to indemnify and hold harmless BidIntell and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
Either party may terminate the agreement at any time. We may suspend or terminate your account for violations of these Terms, non-payment, or any conduct we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination.
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
This Privacy Policy explains how BidIntell ("we," "us," "our") collects, uses, and protects information when you use our Service at bidintell.ai.
Account information: Name, email address, company name, job title, business address, and trade categories when you register.
Bid documents: PDF and other documents you upload for analysis. These are processed by AI to extract project details, and are stored securely in your account.
Bid and outcome data: Project scores, bid amounts, win/loss outcomes, GC and client records, and other business intelligence data you enter.
Usage data: How you interact with the Service, including features used, pages viewed, and actions taken. This is collected via Google Analytics (GA4) and our own event logging.
Payment information: Payment processing is handled by Stripe. We do not store your credit card numbers — Stripe handles all payment data under their own privacy policy.
Communications: Emails you send us or replies to our emails.
When you upload a bid document, it is sent to OpenAI's API for analysis and data extraction. OpenAI processes this content in accordance with their Privacy Policy and API usage policies. OpenAI does not use API data to train their models by default under current enterprise terms.
Extracted data and analysis results are stored in your account and used to generate scores and recommendations.

Each provider processes data in accordance with their own privacy policies and applicable data protection laws.
We do not sell your personal information or bid data to third parties. We share information only as necessary to operate the Service (with the providers listed above) or as required by law (e.g., court orders or legal process).
Aggregated and de-identified intelligence: BidIntell may use anonymized, aggregated patterns from platform-wide bid outcomes to improve its AI scoring models (e.g., regional competition density). This data cannot be traced back to individual users or their specific bids.
We implement industry-standard security measures including encrypted connections (HTTPS/TLS), row-level security policies in our database, and access controls. However, no system is 100% secure — you use the Service at your own risk. Please use a strong, unique password for your account.
We retain your account data for as long as your account is active. If you cancel your subscription, your data is retained for 90 days before deletion to allow for reactivation or data export. You may request deletion of your account and data at any time by emailing hello@bidintell.ai.

We use essential cookies to maintain your login session. Google Analytics uses cookies to collect anonymized usage data. You can disable analytics cookies through your browser settings or a browser extension — this will not affect your use of the Service.
The Service is intended for business professionals aged 18 and older. We do not knowingly collect personal information from individuals under 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.
